We are aware that selling products in foreign markets can be a daunting task. We at Otaolife Ecomerce GmbH (hereinafter known as “Otaolife”) aims to make selling you products in Asia as simple as possible.

In our “Seller’s handbook” we describe the processes and regulations at hand. As the content of this handbook is our intellectual property, it is only handed out to sellers after opening an Otaolife account and/or signing a non-disclosure agreement. Please feel free to contact us if you are interested in selling your products on our platform – it’s probably easier than you would expect.

 

This policy is a part of our Terms of Use. It regulates the works between Otaolife and the seller(s) (herein after known as the “seller”).

d.     What can be sold on Otaolife

 

Otaolife is an online marketplace. Buyers in China come here to purchase high quality items that they might not find anywhere else. Everything listed for sale on Otaolife must be original and produced by your company or your cooperative partner.

Items must be made in Switzerland or be designed/engineered by a Swiss company. The sales of products manufactured outside of Europe is not allowed without specific permission of Otaolife.

While this is not strictly necessary by Chinese law, we uphold as an Otaolife standard, that all products must be legal to be sold commercially in Switzerland without restrictions (all needed licenses etc. available and current at time of sales).

 

 

The quality and packaging of the products you sell must be the same as those sold locally.

The items you sell must have a shelf life of at least 8 months (the expiration date must be at least 8 months in advance at the time of commencement of shipping).

 

b. What cannot be Sold on Otaolife

 

Even if they otherwise meet our marketplace criteria, prohibited items are not allowed to be sold on Otaolife. All listings must offer an item for sale. You may not create an Otaolife listing for the purpose of sharing a referral code, posting a “want ad”, or similar activity that does not offer a physical or digital item for sale.

 

 Otaolife hasa zero-tolerance policy for prohibited items, particularly those that promote, support or glorify hatred, those that promote, support or glorify violence, or are unlawful by Swiss or Chinese law. Sellers deemed to violate this policy can be subject to immediate account suspension or termination, in accordance with our Terms of Use.

Items sold and statements made on otaolife.com may not make, stand for or imply  political statements. Items must also be transportable by the Swiss Post airfreight available on www.post.ch (note: unfortunately this excludes flammable perfumes at the time).

 

Prohibited items

This policy is a part of our Terms of Use. By opening an Otaolife shop, you’re agreeing to this policy and our Terms of Use. If Otaolife has reason to believe you, your content, or your use of the Services violate our Terms, we may deactivate your content to some or all buyers or suspend or terminate your account (and any accounts Otaolife determines is related to your account) and your access to the Services. Generally, Otaolife will notify you that your content or account has been suspended or terminated, unless you’ve repeatedly violated our terms or we have legal or regulatory reasons preventing us from notifying you.

 

The following types of Items are prohibited or restricted on Otaolife:

 

1.        Alcohol, Tobacco, Drugs, Drug Paraphernalia, opium, morphine, heroin, marijuana,  and other addictive narcotics and psychotropic substances (including CBP and hemp products);

2.        Animal Products and Human Remains,

3.        Product containing dangerous germs, pests and other harmful organisms Animals, plants and their products. Foods, medicines or other items that are harmful to human and animal health, come from epidemic areas, and can spread diseases.

4.        Dangerous Items: Various weapons, imitation weapons, ammunition and explosives, radio active and chemical wastes.

5.        Hate Items: Items that Promote, Support, or Glorify Hatred

6.        Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items

7.        Internationally Regulated Items

8.        Nudity and Mature Content

9.        Violent Items: Items that Promote, Support, or Glorify Violence

10.     Infringing items

11.     Items making, standing for or imply political statements

 

The list above applies mutatis mutandis for any content posted on otaolife.com, not only for the product itsel.

 

Most cosmetic products can be shipped to China, except for some products that contain special ingredients. Sellers can check if your product meets the requirements at the link below (Otaolife does not bear responsibility for the accuracy).

Policy decisions are complex. Otaolife considers many different and often divergent factors before coming to a decision about what is best for our community. Because Otaolife is a a creative community, we err on the side of freedom of expression. We also tend to allow items that have educational, historical, or artistic value, but we know that even those items are subject to a variety of valid and sometimes conflicting interpretations and emotional responses.

 

Art and history can be provocative, emotional, and divisive. There are some topics on which we may never reach a consensus as a community, and that is okay. In the words of Joyce Carol Oates, “art should not be comforting; for comfort, we have mass entertainment and one another. Art should provoke, disturb, arouse our emotions, expand our sympathies in directions we may not anticipate and may not even wish.”

 

In order to help provide clarity and insight into our policy making process, we have included the rationale behind our decisions and details about how they will be enforced, including some representative examples below of what is allowed on Otaolife. We reserve the right to remove listings that we determine are not within the spirit of Otaolife. Violating this policy may result in the member’s selling privileges being suspended and/or terminated.

 

c. Managing your Otaolife Shop

 

Your shop represents you and your business to the Otaolife community. It’s important that you, your items and your shop are honestly and accurately represented.

 

By selling on Otaolife, you agree that you will:

 

Provide honest, accurate information to Otaolife and in your About section.

Honour your  Shop Policies.

Ensure your shop content, such as any text, photos or videos used to represent yourself, your shop or your listings, abide by Otaolife’s policies.

Accurately represent your items in listings and listing photos.

Respect the intellectual property of others. If you feel someone has violated your intellectual property rights, you can report it to Otaolife.

Do not engage in fee avoidance.

Do not create duplicate shops or take any other action (such as manipulating clicks, baskets or sales) for the purpose of shilling , manipulating search or circumventing Otaolife’s policies.

Do not coordinate pricing with other sellers.

 

d. Seller Standards

By listing a product for sale on Otaolife you understand and agree that you are responsible for complying with all applicable laws and regulations for the products you list for sale, including any required labels and warnings. Otaolife assumes no responsibility for the accuracy, labelling, or content of your listings.

 

Meeting Service Level Standards

 

Sellers must provide great customer service and maintain trust with the buyers. These requirements are called our Seller Service Level Standards. Otaolife may reach out to you if your shop fails to meet Otaolife's Seller Service Level Standards. Read more here.

 

By selling on Otaolife, you agree to:

 

Honour your dispatch times (time until the package is handed over to the Post or applicable transport company). Sellers are obligated to dispatch an item or otherwise complete a transaction with a buyer in a prompt manner, unless there is an exceptional circumstance. Please be aware that legal requirements for dispatch times vary by country. Read more in our Delivery Policy.

Respond to Messages in a timely manner.

Honour the commitments you make in your own shop policies.

If you are unable to complete an order, you must notify the buyer and cancel the order. Read about how to cancel an order in seller’s handbook.


e. Selling Fees

 

Sellers may be charged for using some of Otaolife’s services. There are fees associated with selling, advertising, and certain other Otaolife products and features. You can find information on fees in the Seller’s Handbook.

The profit of Otoalife and any pricing details besides shipment fee is to be considered confidential (also between other sellers on Otaolife).

 

2. Being a Member of the Otaolife Community

At Otaolife, everyone is expected to treat fellow members of the Otaolife community with respect. As a seller, you have additional responsibilities to safeguard personal information and communicate promptly with buyers in order to provide a great customer experience.

 

a. Creating and Uploading Content

 

As a member of Otaolife, sellers have the opportunity to create and upload a variety of content, like listings, Messages, text, photos, and videos. In order to keep our community safe and respectful, you agree that you will not upload content that:

 

Contains hateful or derogatory language or imagery, or any content that is subject to our Anti-Discrimination and Hate Speech Policy;

Contains threats, harassment, extortion, or violates our rules about interference;

Violates someone else’s intellectual property rights;

Is false, deceptive, or misleading;

Contains unsolicited advertising or promotions, requests for donations, or spam;

Contains private information, whether it is your own, or someone else’s;

Encourages or facilitates a transaction that evades the Otaolife checkout process;

Contains prohibited medical drug claims;

Makes, implies or stands for a political statement,

Violates any of the rules described in our Prohibited Items Policy.

Contains any implication of sales by another channel than otaolife.com.

Some content on Otaolife is subject to additional requirements. Please see below for more details.

 

b. Privacy and Protecting Personal Information

 

You are responsible for protecting members’ personal information you receive or process, and you must comply with all relevant legal requirements. This includes applicable data protection and privacy laws that govern the ways in which you can use Otaolife user information. These laws may require that you post and comply with your own privacy policy,. Your privacy policy must be compatible with this policy and Otaolife’s Terms of Use, and Otaolife's Privacy Policy.

 

In particular, when you sell using our Services (subject to this Policy) or use Otaolife’s API , you may receive and determine what to do with certain personal information, such as when communicating with users and entering into transactions with buyers. This means you process personal information (for example, buyer name, email address, and delivery address) and, to the extent you do so,  you are an independent controller of data relating to other users that you may have obtained through the Services.. As a data controller (that is someone who decides what personal data is collected and the purpose you’ll use the data for) to the extent that you process user personal information outside of the Services, you may be required under applicable data protection and privacy laws to honour requests received from such users for data access, portability, correction, deletion, and objections to processing. Also, if you disclose personal information without the buyer’s proper consent, you are responsible for that unauthorised disclosure. This includes, for example, disclosures you make or unintentional data breaches. For example, you may receive a buyer’s email address or other information as a result of entering into a transaction with that buyer. This information may only be used for Otaolife-related communications or for Otaolife-facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorised transactions. Without the buyer’s consent, and subject to other applicable Otaolife policies and laws, you may not add any Otaolife member to your email or physical mailing list, use that buyer’s identity for marketing, or obtain or retain any payment information. Please bear in mind that you're responsible for knowing the standard of consent required in any given instance. If Otaolife and you are found to be joint data controllers of personal information, and if Otaolife is sued, fined, or otherwise incurs expenses because of something that you did in your capacity as a joint data controller of buyer personal information, you agree to indemnify, defend and hold Otaolife (and its employees, agents, consultants, subsidiaries, partners, affiliates, and licensors) harmless against any claims, costs, losses, damages, liabilities, judgements and expenses (including reasonable lawyer fees) in connection with your processing of buyer personal information.

c. Communication Standards

 

i. Messages

 

With Otaolife's "Messages", you have the ability to communicate directly with your buyers or other Otaolife members. Messages are a great way for buyers to ask you questions about an item or an order.

 

Messages may not be used for the following activities:

 

Sending unsolicited advertising or promotions, requests for donations or spam;

Harassing or abusing another member or violating our Anti-Discrimination Policy;

Contacting someone after they have explicitly asked you not to; 

Interfering with a transaction or the business of another member;

Exchanging personal contact, financial or other information for the purposes of evading the checkout process on Otaolife, including phone number, address, email, social media handles, external URLs, instructions for money transfer, etc.

Interference

 

Interference occurs when a member intentionally interferes with another member’s shop in order to drive away their business. Interference is strictly prohibited on Otaolife. Examples of interference include:

 

Contacting another member via Messages to warn them away from a particular member, shop, or item;

Posting in public areas to demonstrate or discuss a dispute with another member;

Purchasing from a seller for the sole purpose of leaving a negative review;

Creating or using an independent buyer account to maliciously up-vote another shop’s negative reviews in order to position those reviews more prominently.

Harassment and Discrimination

 

Any use of Messages to harass other members is strictly prohibited. Similarly, Messages may not be used to support or glorify hatred or otherwise violate our Anti-Discrimination Policy. If you receive a Message that violates this policy, please let us know right away.

 

ii. Forums and Teams

 

Forums and Teams are public spaces provided by Otaolife where sellers can connect, but there are communication standards that must be followed. More information can be found in the Otaolife Community Policy.

 

iii. Communicating Cancellations

 

If you are unable to complete a transaction, you must notify the buyer via Messages and cancel the transaction. If the buyer already submitted payment, you must issue a full refund. You are encouraged to keep proof of any refunds in the event a dispute arises. All cancellations are subject to our Cancellation Policy.

 

 

Please be aware that in addition to this policy, each country has its own laws surrounding delivery, cancellations, returns and exchanges. Please familiarise yourself with the laws of your own country and those of your buyers’ countries.

 

Sellers may still cancel an order and work toward a resolution with a buyer as they see fit for policies applied to their shops, such as the digital items policy.


3. Feedback, Cases and Your Success

a. Reviews

 

Reviews are a great way for you to build a reputation on Otaolife. Buyers can leave a review, including a one to five star rating and a photograph or video of their purchase, within 100 days after the latter date of their item’s estimated delivery date. If an estimated delivery date is not available, the review window opens after the order’s processing time and delivery time have elapsed. Buyers can edit their review, including the photograph or video, any number of times during that 100 day period.

 

On the rare occasion you receive an unfavourable review, you can reach out to the buyer or leave a response.

 

In addition to our rules for Creating and Uploading Content in Section 2a, reviews and your response to reviews may not:

 

Contain graphic, mature, or obscene language or imagery, or any content that is subject to our mature content policy;

Be about things outside the seller’s control, such as a delivery company, Otaolife or a third party;

Include shilling  or otherwise falsely inflate a shop’s review score; 

Undermine the integrity of the Reviews system.


b. Your Seller Account and Otaolife’s Terms

 

In order to keep Otaolife safe and improve our Services, we may take actions that limit the visibility of your shop, listings or ads, or that impact your payment account. In the event a shop sees unusual order activity, or we otherwise believe that your actions or shop may result in buyer disputes, chargebacks, increased risk of fraud, counterfeiting, or other claims, Otaolife may take actions such as limiting visibility of your account, or placing restrictions or reserves on your payments account, in accordance with our Terms of Use, including this Policy and our Otaolife Payments Policy. When appropriate and permitted by law, Otaolife will communicate information to the affected seller about the issue.

 

 

We may limit the visibility of listings or ads in the interest of keeping Otaolife safe, and improving our Services. For example, listings or ads may have decreased visibility because they include terms that represent a prohibited item or based on third party policies. These listings or ads may also be restricted from appearing in one or more features of the Services. While these listings or ads may have limited visibility, they are still discoverable in search.

 

Otaolife may make changes to onboarding or authentication processes for sellers at our sole discretion. Completion of these processes may be required for seller account activation or continued access and usage.

 

If Otaolife has reason to believe a seller, a seller’s content, or a seller’s  use of the Services violate our Terms, including this Seller Policy, Otaolife may deactivate  such content to some or all users, or suspend or terminate relevant  accounts (and any accounts Otaolife determines is related to your account) and your access to the Services. Generally, Otaolife will notify you that Your Content or account has been suspended or terminated, unless you’ve repeatedly violated our Terms or we have legal or regulatory reasons preventing us from notifying you.

 

Please read this rule carefully. If you pass the store application, it means that you agree to the terms of use mentioned above.
